1. Acceptance of Terms
Welcome to AI Chatbot SaaS. By creating an account, accessing, or using our platform (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you may not use the Service.
These Terms apply to all visitors, registered users, and paying subscribers. You may accept them on behalf of a company or organization, in which case "you" refers to that entity.
2. Accounts & Eligibility
You must be at least 16 years old to use the Service. You are responsible for:
- Providing accurate, current, and complete registration information;
- Safeguarding your password and API keys — all activity under your account is your responsibility;
- Notifying us immediately of any unauthorized access or security breach.
One person or legal entity may maintain a single primary account unless we agree otherwise in writing.
3. Plans, Billing & Refunds
The Service is offered under a Free plan and paid subscription plans (Pro, Business, Enterprise) as described on our Pricing page. Each plan includes a defined quota of chatbots, knowledge-base storage, and monthly messages.
- Billing cycles: subscriptions are billed monthly or annually in advance. Annual plans benefit from a 15% discount.
- Renewal: plans renew automatically at the end of each cycle unless cancelled before the renewal date.
- Upgrades / downgrades: take effect immediately; the new quota applies right away.
- Overage: when your plan's message quota is exhausted, chatbots stop responding until the next cycle or an upgrade.
- Refunds: payments are non-refundable except where required by law or at our sole discretion.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, or infringe the rights of others;
- Distribute spam, phishing, malware, or deceptive content;
- Build chatbots that impersonate real people without disclosure, promote hate, harassment, or violence;
- Scrape, reverse-engineer, resell, or overload the Service or attempt to circumvent usage limits;
- Upload content you do not have the right to use, including copyrighted material or personal data collected without consent.
We may suspend accounts that violate these rules, with or without prior notice where legally permitted.
5. Your Content & Data
"Your Content" means everything you upload or connect to the Service: website pages, documents, training data, chatbot configurations, and the conversations your chatbots have with end users.
You retain full ownership of Your Content. You grant us a limited, worldwide, non-exclusive licence to host, process, and reproduce it solely to operate and improve the Service on your behalf. We do not sell your data or use Your Content to train third-party models.
You are responsible for ensuring you have a lawful basis (e.g. consent) for any personal data contained in Your Content, in accordance with applicable data-protection laws such as the GDPR.
6. AI-Generated Responses
Chatbots built with the Service generate responses using artificial intelligence based on the data you provide. AI output may occasionally be inaccurate, incomplete, or outdated.
You acknowledge that AI-generated responses are provided "as is" and that you remain responsible for reviewing, moderating, and supervising the behaviour of the chatbots you deploy. We do not guarantee that any chatbot will answer correctly, comply with your business rules, or be free of errors.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, third-party outages (e.g. AI providers, WhatsApp gateways), or events beyond our reasonable control.
8. Suspension & Termination
You may cancel your subscription at any time from your account; cancellation stops future billing and takes effect at the end of the current cycle.
We may suspend or terminate your account if you breach these Terms, fail to pay due amounts, or if your use of the Service creates legal risk or harm to us or others. Where practicable, we will give you notice and a reasonable opportunity to remedy the issue.
Upon termination, your right to use the Service ends and data associated with your account may be permanently deleted after a grace period of 30 days.
9. Disclaimers & Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, our total aggregate liability arising from or related to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
10. Changes & Contact
We may update these Terms from time to time. Material changes will be announced on the Service or by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
